The process for dealing with party walls in relation to building and construction works, particularly any conversions or extensions to your premises, can be intricate. However, if party wall notices are considered from the outset of a project, and you are sure to appoint surveyors to carry out the requisite surveys as soon as possible then it can be easier to get a Party Wall Agreement.
You must seek a Party Wall Agreement if your planned work consists of either building on or at the boundary line between two properties, or on an existing party wall or structure, or if your project requires digging below and near to the existing foundation line of the neighbouring property. In all of these situations, you must submit a Party Wall Notice to the owner of the adjoining property. This includes all owners of the property, so if the adjoining property is a leasehold or home with multiple occupancy you might need to serve this notice to several people. Your Party Wall Notice should include information regarding yourself and your property as well as information regarding the extent and nature of the proposed work.
